Terms of Service

1. What Old Games Basement is

Old Games Basement (the “Service”), operated by Brightwing Systems, LLC, is a private shelf for old computer games. It runs emulators and game engines in your browser, keeps the games on your shelf, remembers your saved games, and gathers what is known about how each game is played. By using the Service you agree to these terms.

2. Your account

You are responsible for what happens under your account and for keeping your credentials secure. Accounts are for people, not for sharing — your shelf, your saved games and your settings are yours alone.

3. The games — please read this one

When you add a game, the Service fetches it from a public archive and stores a copy on your shelf. That copy is private to you. It is not published, not indexed, not listed anywhere public, and not offered to anyone else. There is no public catalogue of playable games here and no way for a visitor to browse or download what is on your shelf.

Old Games Basement does not condone piracy and is not a way to get around paying for games. We ask you to use it only for software you are entitled to use — because you own a copy, because the rightsholder has released it, because it is genuinely abandoned or in the public domain where you live, or because your local law otherwise allows it. By adding a game you confirm that this is true for that game, and you accept responsibility for the choice.

Please do not assume that age settles it. These games are decades old and many have had no commercial life for a long time, but old is not the same as out of copyright — most games from the 1980s and 1990s are still protected, often for several decades yet, and some are still sold today. If a game is available to buy, buy it. It is the better copy and the people who made it are still around.

4. If you are a rightsholder

Write to legal@brightwingsystems.com and tell us what you hold rights in. We will remove it, stop it being addable, and confirm when it is done. You do not need a lawyer to ask, and we would rather hear from you early than argue later.

5. Acceptable use

Do not use the Service to break the law, to disrupt or overload it, to work around its limits, or to make its contents available to other people. Do not use it to distribute anything you do not have the right to distribute.

6. Your saved games and your shelf

We keep your shelf and your saved games so the Service works. We do not read your saved games, sell anything, or use what you play to advertise to you. You can remove a game or delete your account at any time; see the Privacy Policy for what that removes and when.

7. Availability

This is a small service run on one server. It may be unavailable, it may lose data, and it may change or stop. Keep your own copies of anything you would be sorry to lose.

8. Termination

We may suspend or end access that breaks these terms. You may stop using the Service at any time.

9. Disclaimer

The Service is provided “as is”, without warranties, to the fullest extent permitted by law. Nothing here is legal advice, including the parts of §3 that describe copyright — if you need to know where you stand, ask a lawyer in your own country.
